バーチャルクロス（以下「当社」）は、当社が提供するモバイルアプリケーション「fabulaouscam」（以下「本アプリ」）における利用者情報の取り扱いについて、以下のとおりプライバシーポリシー（以下「本ポリシー」）を定めます。
1. 取得する情報と利用目的

2. 第三者への提供・委託
当社は、次の場合を除き、取得した個人データを第三者に提供しません。
- 利用者の同意がある場合（第3条の Decart.ai Inc. への提供は、この同意にもとづいて行います）
- 法令に基づく場合
- 合併、事業譲渡その他の事由による事業の承継に伴って提供する場合
- 利用目的の達成に必要な範囲で、次の事業者に個人データの取扱いを委託する場合
当社は、委託先を適切に選び、契約により安全管理の措置を確保し、必要かつ適切な監督を行います。

広告の配信（Google AdMob）、アプリ内課金（App Store・Google Play）、音声テロップの音声認識（Apple Inc.、端末の音声認識サービスの提供者）および Android 版の ML Kit（Google LLC）は、利用者の端末から各事業者に情報が直接送られ、各事業者が自らのプライバシーポリシーに従って取り扱います。これらは当社からの提供でも委託でもありません（第6条）。
3. 外部AIサービスへの送信
本アプリのAI機能は、次の外部のAIサービスを利用します。送信するのは、利用者が同意したうえでAI機能を実行した場合に限ります。

写真・映像に写っている人の顔も含まれます。音声と顔データ（第4条）は送信しません。
- 利用目的：加工結果を作成し、本アプリに返すため。Decart.ai Inc. は、受け取った写真・映像・指示文を、加工結果の作成のほか、同社の AI モデルの学習と改善にも利用します。この利用は取り消せません。そのため、同社への送信は業務の委託ではなく、同意にもとづく外国にある第三者への提供です。Features & Labels, Inc. には同社に保存しない設定で送信し、同社は処理のためにのみ利用します。
- 送信先の国の制度（米国）：連邦法としての包括的な個人情報保護法はなく、分野ごとの法律と州法（カリフォルニア州など）があります。米国は APEC の越境プライバシールール（CBPR）に参加しています。詳しくは個人情報保護委員会の資料（米国）をご覧ください。
- Decart.ai Inc. が講じている措置：同社のデータ処理契約（Data Processing Addendum の Annex II・7.1。2026年10月9日に当社が確認した範囲）は、業務に必要な範囲に限ってアクセス権限を与え、アクセスの記録を12か月以上保存すると定めています。また、安全上の事故を知ったときは48時間以内に当社に通知すると定めています。同社は、SOC 2 Type 2 と ISO/IEC 27001 の認証を維持していると表明しています。ただし、同社の規約では API 利用規約がデータ処理契約より優先し、送信した情報の保存期間は公表されていません。
- 同意：本アプリは、AI機能を初めて使う前に、送信する情報、送信先とその国、利用目的、米国の制度および Decart.ai Inc. が講じている措置を画面に表示し、利用者の同意を得ます。同意がない限り送信しません。同意しなくても、AI機能以外はご利用いただけます。同意は本アプリの「設定」からいつでも取り消せます。取り消す前に送った情報は、各社の定めに従って扱われます。
- お願い：写真や映像にほかの人が写っている場合は、その人の了解を得てから送ってください。
- 送信経路：当社のサーバー（Cloudflare 上で稼働）を経由して送信します。当社のサーバーは写真・映像・指示文を中継するだけで、保存しません。
- 当社は、AI機能で送信された写真・映像・指示文を、加工結果を利用者に返す目的以外には利用しません。
4. 顔データの取り扱い
本アプリは、次の機能のために、端末内で画像から顔の位置（顔の範囲）と顔の特徴点（輪郭・目・鼻・あごなどの位置）、および人物の範囲を検出します（以下「顔データ」）。検出には、iOS では Apple の Vision フレームワーク、Android では Google の ML Kit（端末内で動作するモデル）を使います。
- フェイス調整（小顔・小鼻・デカ目・あご）および広角小顔：顔の特徴点に合わせて画像を変形するため
- 顔追従（iOS 版のみ）：顔が画面の中央にくるよう表示範囲を調整するため
顔データは、上記の加工のためだけに、撮影中の映像の各コマまたは撮影した画像ごとに端末のメモリ上で一時的に計算し、加工が終わるとただちに破棄します。顔データを端末に保存すること、当社のサーバーや第三者（外部のAIサービスを含む）に送信すること、個人の識別・認証・広告・分析に利用することはありません。したがって、顔データの保存期間はありません。なお、Android の ML Kit は、端末内で動作する場合でも、機種・OS の版などの端末の情報、アプリの版、インストールごとの識別子、性能の指標と利用状況を Google LLC に送信します。画像そのものや顔データは送信しません（第6条）。
なお、利用者が同意のうえAI機能を実行した場合は、人物の顔が写った写真・映像そのものが第3条のとおり外部のAIサービスへ送信されますが、その場合も顔データは送信しません。
5. 外国にある第三者への提供・外国の委託先
(1) 同意にもとづく提供（Decart.ai Inc.）
当社は、AI機能（「AIで編集」「リアルタイムAI」）を使う利用者の同意を得て、第3条の情報を Decart.ai Inc.（米国）に提供します。同意を得る前に、米国の個人情報の保護に関する制度と、同社が講じている措置を画面でお知らせします（個人情報の保護に関する法律第28条第1項・第2項、同法施行規則第17条）。お知らせする内容は第3条のとおりです。
(2) 外国にある委託先
第2条の委託先（Cloudflare, Inc.、Features & Labels, Inc.）は米国の事業者で、日本国外で個人データを取り扱います。当社は、各事業者が、個人情報の保護に関する法律第4章第2節の規定の趣旨に沿った措置（安全管理、委託された目的以外の利用の禁止、再委託先の管理、漏えい時の報告等）を継続的に講じる体制を整備していることを、次の方法で確認しています（同法第28条第1項、同法施行規則第16条）。
- Cloudflare, Inc.：同社が取得しているグローバル CBPR の認証
- Features & Labels, Inc.：当社と同社との間の契約（データ処理に関する追加条項）
当社は、年に1回以上、これらの措置の実施状況と、その実施に影響を及ぼすおそれのある外国の制度を確認します。米国の個人情報の保護に関する制度は、個人情報保護委員会のウェブサイト（https://www.ppc.go.jp/personalinfo/legal/kaiseihogohou/#gaikoku ）で確認できます。これらの措置について、ご請求があれば、法令の定めに従い、第13条の窓口でご案内します（同法第28条第3項）。
6. 端末から外部へ送信される情報
本アプリは、利用者の端末から次の送信先へ情報を送信します。表の上の2行（当社のサーバーへの送信と、当社のサーバーを経由した送信）を除き、送信先の事業者は利用者の端末から情報を直接受け取り、それぞれのプライバシーポリシーに従って自らの責任で取り扱います。これは当社からの個人データの提供ではありません。当社がこれらの事業者から受け取るのは、表の「当社が受け取るもの」に記載したものだけです。

7. トラッキングと広告について
iOS 版は、初回起動時等にトラッキングの許可を求めます。許可しない場合でも本アプリの主要機能はご利用いただけますが、表示される広告が最適化されない場合があります。Android 版では、対象地域の利用者に Google User Messaging Platform を通じて広告に関する同意を求めます。広告に関する設定は端末の「設定」からいつでも変更できます。
8. 安全管理措置
当社は、個人データの漏えい、滅失または毀損の防止その他の安全管理のため、次の措置を講じています。
- 基本方針の策定: 本ポリシーを定め、公表しています。
- 組織的・人的安全管理措置: 個人データの取扱いの責任者を定め、取り扱う者を限定しています。
- 物理的安全管理措置: 個人データを取り扱う端末の盗難・紛失を防ぎ、第三者が閲覧できないように管理しています。
- 技術的安全管理措置: 通信を暗号化（HTTPS）し、サーバーおよび管理画面へのアクセスを認証により制限しています。外部AIサービスを利用するための鍵はアプリに置かず、当社のサーバーでのみ管理しています。
- 外的環境の把握: 当社は、米国にある事業者（Cloudflare, Inc.、Features & Labels, Inc.）に個人データの取扱いを委託しています。また、当社のサーバーのデータはアジア太平洋地域のデータセンターに保存されます（国は特定できません）。米国の個人情報の保護に関する制度を把握したうえで、安全管理措置を講じています（第2条・第5条）。
9. データの保存・削除
撮影・編集した写真および動画は、原則として利用者の端末内に保存されます。利用者は端末上でいつでも削除できます。顔データは保存しません（第4条）。AI機能のために Decart.ai Inc. へ送信した情報は、同社の定めに従って扱われます。具体的な保存期間は公表されていません（第3条）。「高解像度化」のために Features & Labels, Inc. へ送信する写真は、同社に保存しない設定で送信します。
利用状況の記録（各機能の利用回数・利用秒数）と購入の識別子は、利用枠の管理と不正利用の防止のため、当社のサーバー（Cloudflare 上で稼働）に保存します。
10. 開示等の請求
利用者は、当社が保有する自己の保有個人データについて、利用目的の通知、開示（第三者提供記録の開示を含みます）、内容の訂正・追加・削除、利用の停止・消去および第三者への提供の停止を請求できます。請求は、info@virtual-cross.com までメールでご連絡ください。当社は、ご本人またはその代理人であることを、請求の内容に応じた方法で確認したうえで、法令に従い遅滞なく対応します。手数料はいただきません。
11. 未成年者の利用
13歳未満の方は本アプリを利用できません（利用規約第3条）。未成年の方は、法定代理人の同意を得たうえでご利用ください。
12. 本ポリシーの変更
当社は、本ポリシーを改定することがあります。改定した場合は本ページに掲示し、重要な変更は、効力が生じる前に本ページまたは本アプリ内でお知らせします。

VirtualCross ("we") sets out below how user information is handled in the mobile application "fabulaouscam" (the "App"), which we provide.
1. Information we collect and why

2. Sharing and processing by others
We do not provide the personal data we collect to third parties, except:
- with your consent (the provision to Decart.ai Inc. described in Section 3 is made on the basis of this consent);
- where required by law;
- where information is provided as part of the succession of our business through a merger, business transfer or similar event; or
- where we entrust the handling of personal data to the companies below, to the extent needed to achieve the purposes above.
We choose these service providers carefully, secure appropriate security measures by contract, and supervise them as necessary and appropriate.

Ad delivery (Google AdMob), in-app purchases (App Store and Google Play), speech recognition for Voice Captions (Apple Inc. and the provider of the device's speech recognition service) and ML Kit on Android (Google LLC) receive information directly from your device and handle it under their own privacy policies. This is neither a provision of data by us nor an entrustment (Section 6).
3. Sending data to a third-party AI service
The App's AI features use the external AI services below. Data is sent only when you consent and run an AI feature.

Faces of people in the photo or video are included. Audio and face data (Section 4) are not sent.
- Purpose: to produce the result and return it to the App. Decart.ai Inc. uses the photos, video and instructions it receives not only to produce the result but also to train and improve its AI models, and this use cannot be revoked. Sending data to Decart.ai Inc. is therefore not an entrustment of handling but a provision to a third party in a foreign country, based on your consent. Data is sent to Features & Labels, Inc. with a setting that tells it not to store the data, and Features & Labels, Inc. uses it only for processing.
- Data protection in the destination country (USA): there is no comprehensive federal data protection law; instead there are sector-specific laws and state laws (such as California's). The USA participates in the APEC Cross-Border Privacy Rules (CBPR) system. For details, see the report on the USA by Japan's Personal Information Protection Commission (in Japanese).
- Measures taken by Decart.ai Inc.: its data processing agreement (Annex II and Section 7.1 of its Data Processing Addendum, as far as we confirmed on October 9, 2026) provides that access permissions are granted only to the extent required for the role and that access logs are kept for at least 12 months, and that it will notify us within 48 hours of becoming aware of a security incident. Decart.ai Inc. states that it maintains SOC 2 Type 2 and ISO/IEC 27001 certifications. However, under its terms its API Terms take precedence over the data processing agreement, and it does not publish how long it keeps the data sent to it.
- Consent: before you first use an AI feature, the App shows what will be sent, the recipients and their country, the purpose, the US data protection system and the measures taken by Decart.ai Inc., and asks for your consent. Nothing is sent without it. All features other than AI remain available if you decline. You can withdraw consent at any time in the App's Settings; data sent before you withdraw is handled under each company's own rules.
- Please note: if other people appear in a photo or video, get their permission before you send it.
- Route: data passes through our server running on Cloudflare. Our server only relays photos, video and instructions and does not store them.
- We do not use photos, video or instructions sent for AI features for any purpose other than returning the result to you.
4. Face data
For the features below, the App detects, on your device, the position of faces (face bounds), facial landmarks (outline, eyes, nose, chin and similar points) and the area of a person in the image ("face data"). Detection uses Apple's Vision framework on iOS and Google's ML Kit (a model that runs on the device) on Android.
- Face adjustment (slimmer face, nose, larger eyes, chin) and Wide Slim: to reshape the image to match the facial landmarks
- Face Tracking (iOS only): to keep the face centered in the frame
Face data is computed temporarily in device memory for each frame of the live camera image or each captured photo, only for the processing above, and is discarded as soon as that processing finishes. Face data is never stored on the device, never sent to our server or any third party (including the external AI services), and never used for identification, authentication, advertising or analytics. There is therefore no retention period for face data. On Android, ML Kit sends device information such as the model and OS version, the app version, a per-installation identifier, and performance and usage metrics to Google LLC, even though it runs on the device. It does not send the images themselves or face data (Section 6).
When you consent and run an AI feature, the photo or video itself, including any faces in it, is sent to an external AI service as described in Section 3; face data is not sent in that case either.
5. Provision to and entrustment of companies outside Japan
(1) Provision based on your consent (Decart.ai Inc.)
With the consent of users who use the AI features "AI Edit" and "Real-time AI", we provide the information described in Section 3 to Decart.ai Inc. (USA). Before asking for consent, the App shows the US data protection system and the measures taken by Decart.ai Inc. (Article 28(1) and (2) of Japan's Act on the Protection of Personal Information and Article 17 of its Enforcement Rules). What is shown is set out in Section 3.
(2) Service providers outside Japan
The service providers in Section 2 (Cloudflare, Inc. and Features & Labels, Inc.) are US companies and handle personal data outside Japan. We have confirmed that each of them has a system in place to continuously take measures in line with Chapter IV, Section 2 of Japan's Act on the Protection of Personal Information (security, no use beyond the entrusted purpose, control of sub-processors, breach reporting, etc.), as follows (Article 28(1) of the Act and Article 16 of its Enforcement Rules):
- Cloudflare, Inc.: its Global CBPR certification
- Features & Labels, Inc.: our contract with it (data processing addendum)
We review these measures and any foreign laws that may affect them at least once a year. Information about the personal information protection system of the USA is available on the website of the Personal Information Protection Commission of Japan (https://www.ppc.go.jp/personalinfo/legal/kaiseihogohou/#gaikoku ). On request, we will provide further information about these measures as required by law, at the contact point in Section 13 (Article 28(3) of the Act).
6. Information sent from your device
The App sends information from your device to the following recipients. Except for the first two rows (sending to our server and sending through our server), the recipients receive information directly from your device and handle it on their own responsibility under their own privacy policies. This is not a provision of personal data by us. The only things we receive from these recipients are those listed under "What we receive".

7. Tracking and advertising
On iOS, the App asks for tracking permission, for example on first launch. The App's main features remain available if you decline, though the ads shown may be less relevant. On Android, users in applicable regions are asked for advertising consent through the Google User Messaging Platform. You can change advertising settings at any time in your device's Settings.
8. Security measures
We take the following measures to prevent leaks, loss or damage of personal data and otherwise keep it secure.
- Basic policy: we have set out and published this policy.
- Organisational and personnel measures: we have appointed a person responsible for handling personal data and limit who handles it.
- Physical measures: we keep devices used to handle personal data safe from theft and loss, and out of view of third parties.
- Technical measures: communications are encrypted (HTTPS), and access to servers and administrative screens is restricted by authentication. Keys for the external AI services are not placed in the App and are held only on our server.
- Understanding the external environment: we entrust the handling of personal data to companies in the USA (Cloudflare, Inc. and Features & Labels, Inc.), and data on our server is stored in data centres in the Asia-Pacific region (the country cannot be identified). We take security measures based on an understanding of the personal information protection system of the USA (Sections 2 and 5).
9. Storage and deletion
Photos and videos you capture or edit are stored on your device as a rule, and you can delete them on your device at any time. Face data is not stored (Section 4). Data sent to Decart.ai Inc. for AI features is handled under its own rules; it does not publish a specific retention period (Section 3). Photos sent to Features & Labels, Inc. for Enhance are sent with a setting that tells it not to store them.
Usage records (how many times and for how many seconds each feature is used) and purchase identifiers are stored on our server (running on Cloudflare) to manage usage allowances and prevent abuse.
10. Requests for disclosure and other actions
You may ask us to notify you of the purpose of use of, disclose (including records of provision to third parties), correct, add to or delete, stop using or erase, or stop providing to third parties, the retained personal data about you that we hold. Please email info@virtual-cross.com. After confirming that the request comes from you or your representative, by a method suited to the request, we will respond without delay in accordance with the law. We charge no fee.
11. Use by minors
Persons under 13 may not use the App (Article 3 of the Terms of Use). Minors should use the App with the consent of a parent or legal guardian.
12. Changes to this policy
We may revise this policy. Revisions are posted on this page, and significant changes are announced on this page or in the App before they take effect.
