第1条（適用）

本規約は、バーチャルクロス（以下「当社」）が提供するカメラアプリ「fabulaouscam」（以下「本アプリ」）の利用条件を定めるものです。利用者は、本アプリを利用することで本規約に同意したものとみなされます。

第2条（本アプリの内容）

本アプリは、写真・動画の撮影、フィルターやフェイス調整などの加工、および外部のAIサービスを利用した機能（「AIで編集」「リアルタイムAI」「高解像度化」。以下「AI機能」）を提供します。一部の機能は、有料プラン（第8条）の利用者のみが利用できます。

撮影した写真・動画は、原則として利用者の端末内に保存されます。端末の故障・紛失・アプリの削除などにより失われた写真・動画を、当社が復元することはできません。

第3条（AI機能の利用）

AI機能を使うと、利用者が選んだ写真・動画、カメラ映像、指示文が、当社のサーバーを経由して外部のAIサービスへ送信されます。送信先と取り扱いはプライバシーポリシーに定めるとおりです。本アプリは、AI機能を初めて使う前に利用者の同意を得ます。

AI機能の結果はAIが生成するものであり、元の写真・映像や実物と異なる内容が含まれる場合があります。「高解像度化」は細部をAIが描き直すもので、写っていなかった情報を復元するものではありません。利用者は、結果を事実の記録や証拠として用いないものとします。

他人が写っている写真・映像をAI機能に用いる場合、利用者は、その人の同意を得るなど、権利を侵害しないよう配慮するものとします。

第4条（禁止事項）

利用者は、本アプリの利用にあたり、次の行為をしてはなりません。

1. 法令または公序良俗に違反する行為
2. 第三者の著作権、商標権、肖像権、プライバシーその他の権利を侵害する行為
3. 他人の写真・映像を、その人の同意なくAI機能で加工し、またはその結果を公開する行為
4. AI機能で加工した写真・映像を、実在の人物の発言・行動の記録であるかのように示し、第三者を誤認させる行為
5. わいせつな内容、児童を性的に扱う内容、暴力的な内容、差別を助長する内容その他著しく不快感を与える内容を、AI機能で生成しようとする行為
6. 他人を誹謗中傷し、または脅迫する目的で本アプリを利用する行為
7. 本アプリまたは当社のサーバーに不正にアクセスし、利用枠や課金の仕組みを不正に回避し、その他本アプリの運営を妨害する行為
8. 本アプリを逆アセンブル、逆コンパイルその他の方法で解析する行為（法令で認められる場合を除く）
9. その他、当社が不適切と判断する行為

利用者が本条に違反した場合、当社は、事前の通知なく、AI機能その他本アプリの全部または一部の利用を停止することがあります。

第5条（写真・動画の権利）

利用者が本アプリで撮影した写真・動画、およびAI機能で加工した結果の権利は、利用者または正当な権利者に帰属します。当社がその権利を取得することはありません。

当社は、AI機能のために送信された写真・映像・指示文を、結果を利用者に返す目的以外には利用しません。外部のAIサービスでの取り扱いは、プライバシーポリシー第3条に定めるとおりです。

第6条（サービスの変更・中断・終了）

当社は、利用者への事前の通知なく、本アプリの内容を変更し、または提供を中断・終了することがあります。AI機能は外部のサービスを利用しているため、外部サービスの事情により、一時的に利用できない場合や、内容が変わる場合があります。

第7条（広告の表示）

本アプリは、無料プランの利用者に広告を表示します。広告の配信は当社以外の事業者が行い、表示される広告の内容を当社が個別に選定するものではありません。

広告に表示された商品・役務に関する取引は、利用者と当該広告主との間で行われるものであり、当社はこれに関与せず、責任を負いません。

広告の配信にあたって取得される情報の取り扱いは、プライバシーポリシーに定めるとおりです。

第8条（有料プラン）

利用者は、本アプリ内で月額のサブスクリプション（以下「有料プラン」）を購入することができます。

1. 価格と内容 各プランの価格と提供内容（広告の非表示、フィルター等の利用、AI機能の毎月の利用枠など）は、本アプリ内の購入画面に表示するとおりとします。
2. 決済と自動更新 決済は、iOS 版では Apple（App Store）、Android 版では Google（Google Play）を通じて行われます。有料プランは、各ストアの定める期限までに解約しない限り、自動的に更新されます。支払方法・請求の時期・解約の方法は特定商取引法に基づく表記のとおりです。
3. 利用枠 AI機能の利用枠は暦月ごとに設定され、翌月に繰り越しません。「リアルタイムAI」は接続するたびに一定の秒数を枠から消費し、途中で接続を止めても消費した分は戻りません。外部サービスの処理に失敗した場合など、当社が定める場合には消費した分を戻します。
4. 引き継ぎ 有料プランは、購入に使った Apple アカウントまたは Google アカウントに紐づきます。同じアカウントであれば、本アプリの「購入を復元」から端末の変更後も引き継げます。iOS 版と Android 版の間では引き継がれません。
5. 返金 有料プランの返品・返金は、原則としてお受けできません。返金は Apple または Google の定める方針および手続によります。当社が直接返金を行うことはできません。不具合が生じた場合は、info@virtual-cross.com までご連絡ください。
6. 提供の終了 当社が本アプリの提供を終了する場合は、事前に本アプリ内または当社ウェブサイトでお知らせします。

第9条（免責）

当社は、本アプリが利用者の特定の目的に適合すること、期待する機能・正確性・有用性を有すること、AI機能の結果が利用者の意図どおりであること、および中断・不具合・データの消失が生じないことを保証するものではありません。

当社の過失（重大な過失を除きます）による債務不履行または不法行為に基づく損害賠償責任は、利用者に現実に生じた通常かつ直接の損害に限られるものとします。

前項の定めは、消費者契約法その他の法令により当社の責任の全部または一部を免除することが認められない場合には、適用されません。

第10条（準拠法および管轄）

本規約の解釈には日本法を準拠法とします。本アプリに関して紛争が生じた場合には、東京地方裁判所を第一審の専属的合意管轄裁判所とします。ただし、利用者が消費者である場合、本条は、法令により認められる裁判所に訴えを提起することを妨げるものではありません。

第11条（本規約の変更）

当社は、必要と判断した場合には、本規約を変更することがあります。重要な変更を行う場合は、本アプリ内または当社ウェブサイトでお知らせします。変更後の規約は、本ページに掲載した時点から効力を生じるものとします。

1. Scope

These terms set out the conditions for using the camera app "fabulaouscam" (the "App") provided by VirtualCross ("we"). By using the App, you are deemed to have agreed to these terms.

2. What the App does

The App lets you take photos and videos, edit them with filters, face adjustment and similar tools, and use features powered by external AI services ("AI Edit", "Real-time AI" and "Enhance"; the "AI Features"). Some features are available only on a paid plan (Section 8).

Photos and videos you take are stored on your device as a rule. We cannot recover photos or videos lost through device failure or loss, deleting the App, or similar causes.

3. Using the AI Features

When you use an AI Feature, the photo or video you choose, the camera feed and your instruction are sent through our server to an external AI service. The recipients and how they handle the data are set out in the privacy policy. The App asks for your consent before you first use an AI Feature.

Results of the AI Features are generated by AI and may differ from the original photo or video or from reality. Enhance redraws fine detail with AI; it does not recover information that was not captured. You agree not to use the results as a factual record or as evidence.

If you use a photo or video showing other people with an AI Feature, you will take care not to infringe their rights, for example by obtaining their consent.

4. Prohibited conduct

When using the App, you must not:

1. break the law or act against public order and morals;
2. infringe the copyright, trademark, portrait, privacy or other rights of others;
3. edit a photo or video of another person with an AI Feature, or publish the result, without that person's consent;
4. present a photo or video edited with an AI Feature as a record of what a real person said or did, misleading others;
5. try to generate, with an AI Feature, obscene content, content that sexualises children, violent or discriminatory content, or other grossly offensive content;
6. use the App to defame or threaten others;
7. gain unauthorised access to the App or our server, improperly circumvent usage allowances or billing, or otherwise interfere with the operation of the App;
8. disassemble, decompile or otherwise reverse-engineer the App, except where permitted by law; or
9. do anything else we consider inappropriate.

If you breach this section, we may suspend your use of the AI Features or of all or part of the App without prior notice.

5. Rights in photos and videos

The rights in photos and videos you take with the App, and in results edited with the AI Features, belong to you or to the rightful owner. We do not acquire those rights.

We do not use photos, video or instructions sent for the AI Features for any purpose other than returning the result to you. How the external AI services handle them is set out in Section 3 of the privacy policy.

6. Changes to the App

We may change the App, or suspend or end it, without prior notice to you. Because the AI Features rely on external services, they may be temporarily unavailable or change for reasons on those services' side.

7. Advertising

The App shows ads to users on the free plan. Ads are delivered by companies other than us, and we do not select individual ads.

Any dealings regarding goods or services shown in an ad are between you and the advertiser; we are not involved and are not responsible for them.

How information is handled for ad delivery is set out in the privacy policy.

8. Paid plans

You may buy a monthly subscription (a "Paid Plan") in the App.

1. Price and contents The price and contents of each plan (no ads, access to filters and similar, monthly allowances for the AI Features, and so on) are as shown on the purchase screen in the App.
2. Payment and auto-renewal Payment is handled through Apple (the App Store) on iOS and Google (Google Play) on Android. A Paid Plan renews automatically unless cancelled by the deadline set by each store. Payment method, billing timing and how to cancel are set out in the Specified Commercial Transactions Act disclosure.
3. Allowances Allowances for the AI Features are set per calendar month and do not carry over. Real-time AI uses a fixed number of seconds from the allowance each time you connect, and the seconds are not returned if you stop early. Where we so provide, such as when an external service fails to process a request, the allowance used is returned.
4. Carry-over A Paid Plan is tied to the Apple account or Google account used to buy it, and carries over to a new device on the same account via "Restore purchases" in the App. It does not carry over between iOS and Android.
5. Refunds Returns and refunds of Paid Plans are not accepted as a rule. Refunds follow the policies and procedures of Apple or Google; we cannot issue them directly. If something is not working, contact us at info@virtual-cross.com.
6. If the App ends If we end the App, we will announce it in advance in the App or on our website.

9. Disclaimer

We do not warrant that the App will suit any particular purpose of yours, that it will have the functionality, accuracy or usefulness you expect, that results of the AI Features will match your intent, or that it will be free of interruptions, faults or loss of data.

Where we are liable for breach of contract or in tort through our own negligence (excluding gross negligence), that liability is limited to the ordinary and direct damage actually suffered by you.

The preceding paragraph does not apply where the Consumer Contract Act or other legislation does not permit us to exclude or limit our liability in whole or in part.

10. Governing law and jurisdiction

These terms are governed by Japanese law. The Tokyo District Court shall have exclusive jurisdiction in the first instance over any dispute relating to the App. Where you are a consumer, however, this article does not prevent you from bringing proceedings in any court having jurisdiction under the applicable law.

11. Changes to these terms

We may change these terms when we consider it necessary. If we make a significant change, we will announce it in the App or on our website. Revised terms take effect when posted on this page.
