第1条（適用）

本規約は、バーチャルクロス（以下「当社」）が提供するアプリおよびウェブサイト「favs」（以下「本サービス」）の利用条件を定めるものです。利用者は、本サービスを利用することで本規約に同意したものとみなされます。

第2条（アカウント）

本サービスの一部の機能は、Apple・Google・LINE のいずれかのアカウントでのサインインを必要とします。

利用者は、自ら選んだ ID（@ から始まる公開名）を通じて本サービスを利用します。ID は公開ページの URL の一部となり、第三者から閲覧できる状態になります。

利用者は、自己のアカウントの管理について責任を負います。

第3条（利用者が登録した内容）

利用者が本サービスに登録したタイトル・画像・リンクなど（以下「投稿内容」）の権利は、利用者または正当な権利者に帰属します。当社がその権利を取得することはありません。

当社は、投稿内容を本サービスの提供に必要な範囲（保存、公開ページでの表示、リンク共有時の画像生成など）でのみ利用します。

利用者は、投稿内容について、自らが権利を有しているか、または適法に利用できることを保証するものとします。

第4条（禁止事項）

利用者は、本サービスの利用にあたり、次の行為をしてはなりません。

1. 法令または公序良俗に違反する行為
2. 第三者の著作権、商標権、肖像権、プライバシーその他の権利を侵害する行為
3. 第三者になりすます行為、または第三者と誤認させる ID を使用する行為
4. 他人を誹謗中傷し、脅迫し、または差別を助長する内容を登録する行為
5. わいせつな内容、暴力的な内容、その他著しく不快感を与える内容を登録する行為
6. 第三者の個人情報を、その同意なく登録する行為
7. 本サービスの運営を妨害する行為、または不正にアクセスする行為
8. 広告、勧誘、その他営利を目的とした利用（当社が認めた場合を除く）
9. その他、当社が不適切と判断する行為

第5条（公開ページ）

公開に設定されたボックスは、URL を知る者であれば誰でも、サインインすることなく閲覧できます。検索エンジンに収集される場合もあります。

利用者は、アプリの設定からいつでも非公開に切り替えることができます。非公開への切り替えは直ちに反映されます。

第6条（内容の報告と当社の措置）

本サービスの公開ページには、不適切な内容を当社に報告するための導線を設けています。報告を受けた場合、当社は内容を確認し、本規約に違反すると判断したときは、事前の通知なく、当該内容の非公開化、削除、またはアカウントの利用停止を行うことがあります。

第7条（サービスの変更・中断・終了）

当社は、利用者への事前の通知なく、本サービスの内容を変更し、または提供を中断・終了することがあります。

第8条（広告の表示）

本サービスは、アプリの画面および公開ページに広告を表示します。広告の配信は当社以外の事業者が行い、表示される広告の内容を当社が個別に選定するものではありません。

広告に表示された商品・役務に関する取引は、利用者または閲覧者と当該広告主との間で行われるものであり、当社はこれに関与せず、責任を負いません。

広告の配信にあたって取得される情報の取り扱いは、プライバシーポリシー第8条に定めるとおりです。

第9条（有料機能）

利用者は、アプリ内で「広告を消す」（以下「本有料機能」）を購入することができます。本有料機能は買い切りであり、継続的な課金は発生しません。

1. 価格 税込100円。価格は変更されることがありますが、変更前に購入した分に影響しません。
2. 決済 Apple（App Store）を通じて行われます。支払方法および請求の時期は、利用者の Apple アカウントの設定によります。
3. 提供される内容 アプリ内の広告の非表示、および利用者自身の公開ページにおける広告の非表示。
4. 引き継ぎ 購入は利用者の Apple アカウントに紐づきます。同一の Apple アカウントであれば、端末を変更しても引き継がれます。アプリの設定にある「購入を復元」から復元できます。
5. 返金 本有料機能の返金は、Apple の定める方針および手続によります。当社が直接返金を行うことはできません。
6. 提供の終了 当社が本サービスの提供を終了した場合、本有料機能も利用できなくなります。

本有料機能は広告の表示を止めるものであり、本サービスのその他の機能に差を設けるものではありません。

第10条（免責）

当社は、本サービスが利用者の特定の目的に適合すること、期待する機能・正確性・有用性を有すること、および中断・不具合・データの消失が生じないことを保証するものではありません。

本サービスには、利用者が登録したリンク先が表示されます。当社は、リンク先の内容を管理しておらず、その内容を保証しません。リンク先の利用は、利用者および閲覧者自身の判断と責任において行われるものとします。

当社の過失（重大な過失を除きます）による債務不履行または不法行為に基づく損害賠償責任は、利用者に現実に生じた通常かつ直接の損害に限られるものとします。

前項の定めは、消費者契約法その他の法令により当社の責任の全部または一部を免除することが認められない場合には、適用されません。

第11条（準拠法および管轄）

本規約の解釈には日本法を準拠法とします。本サービスに関して紛争が生じた場合には、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

第12条（本規約の変更）

当社は、必要と判断した場合には、利用者に通知することなく本規約を変更することがあります。変更後の規約は、本ページに掲載した時点から効力を生じるものとします。

1. Scope

These terms govern use of "favs" (the "Service"), the app and website provided by VirtualCross ("we"). By using the Service you are deemed to have agreed to them.

2. Accounts

Some features require signing in with an Apple, Google or LINE account. You use the Service through an ID you choose (a public name beginning with @). That ID forms part of your public page's URL and is visible to others. You are responsible for managing your own account.

3. Your content

Rights in the titles, images and links you add (your "content") remain with you or the rightful owner. We acquire no rights in them.

We use your content only as needed to provide the Service — storing it, displaying it on your public page, and generating the image used in link previews.

You warrant that you hold the necessary rights in your content, or may otherwise lawfully use it.

4. Prohibited conduct

You must not: break the law or public order; infringe anyone's copyright, trademark, likeness, privacy or other rights; impersonate others or use a misleading ID; post content that defames, threatens or promotes discrimination; post obscene, violent or grossly offensive content; post another person's personal information without their consent; interfere with or gain unauthorised access to the Service; use the Service for advertising or solicitation without our permission; or do anything else we judge inappropriate.

5. Public pages

A box set to public can be viewed by anyone who knows its URL, without signing in, and may be indexed by search engines. You can switch it to private at any time in the app's settings, and this takes effect immediately.

6. Reporting and our response

Public pages carry a way to report inappropriate content to us. On receiving a report we will review the content and, if we judge it to breach these terms, may without prior notice make it private, delete it, or suspend the account.

7. Changes to the Service

We may change, suspend or discontinue the Service without prior notice.

8. Advertising

The Service displays advertising in the app and on public pages. Ads are served by parties other than us, and we do not individually select the ads that appear.

Any dealings with an advertiser arising from an ad are between you (or the viewer) and that advertiser. We take no part in them and bear no responsibility for them.

Information collected in order to serve ads is handled as set out in section 8 of the Privacy Policy.

9. Paid feature

You may purchase "Remove ads" in the app (the "Paid Feature"). It is a one-time purchase; there is no recurring charge.

1. Price JPY 100 including tax. The price may change, but a change does not affect purchases already made.
2. Payment Handled through Apple (the App Store). Payment method and billing timing follow the settings of your Apple Account.
3. What you get No ads in the app, and no ads on your own public pages.
4. Carry-over The purchase is tied to your Apple Account and carries over to a new device using the same Apple Account. Use "Restore purchases" in the app's settings.
5. Refunds Refunds follow Apple's policies and procedures. We cannot issue refunds directly.
6. If the Service ends If we discontinue the Service, the Paid Feature ends with it.

The Paid Feature only stops ads from being shown. It does not otherwise differentiate the features of the Service.

10. Disclaimer

We do not warrant that the Service will suit any particular purpose of yours, that it will have the functionality, accuracy or usefulness you expect, or that it will be free of interruptions, faults or loss of data.

The Service displays the sites you link to. We do not control what is on them and do not warrant their content; visiting them is at your own, and the viewer's own, judgement and risk.

Where we are liable for breach of contract or in tort through our own negligence (excluding gross negligence), that liability is limited to the ordinary and direct damage actually suffered by you.

The preceding paragraph does not apply where the Consumer Contract Act or other legislation does not permit us to exclude or limit our liability in whole or in part.

11. Governing law and jurisdiction

These terms are governed by Japanese law. The Tokyo District Court shall have exclusive jurisdiction in the first instance over any dispute relating to the Service.

12. Changes to these terms

We may change these terms without notifying you. Revised terms take effect when posted on this page.
