This is a reference translation. The Japanese text above is the authoritative version.
Article 1 (Scope)
- These Terms of Use (the "Terms") set out the conditions for using "DualCam" (the "App"), the application provided by VirtualCross ("we").
- You are deemed to have agreed to these Terms from the moment you download or use the App.
- These Terms apply to the Android version of the App obtained from Google Play. The iPhone version obtained from the App Store is governed by the Licensed Application End User License Agreement (Apple's standard EULA) and not by these Terms.
- How your information is handled in the App is set out in our Privacy Policy, which forms part of these Terms.
- Help text and other individual rules we post in the App (the "Individual Rules") form part of these Terms. Where these Terms and the Individual Rules conflict, the Individual Rules prevail.
Article 2 (What the App Does)
- The App is a camera app that shoots with your device's front and back cameras at the same time.
- Photos and videos you take are saved first to the App's own library. They are saved to your device's gallery only when you select them in the library and choose to save them.
- The App is free, with no in-app purchases and no subscriptions.
- The App runs on devices with Android 11 or later. Shooting with the front and back cameras at once requires a device that supports using two cameras simultaneously. On devices that do not, the App shoots with one camera at a time and lets you switch between them.
- You are responsible, at your own cost, for the device and the network connection needed to use the App, including any data charges.
Article 3 (Your Photos and Videos)
- The rights to the photos and videos you take with the App belong to you. We neither obtain nor use them.
- Your photos and videos are stored only on your device and are never sent to our servers. Deleting the App also deletes the App's library.
- You are responsible for backing up your photos and videos. We are not liable if they are lost through deletion of the App, a fault with or loss of your device, an OS update or any similar cause.
Article 4 (Prohibited Conduct)
In using the App, you must not:
- act in breach of the law;
- infringe the rights of others, including by:
- filming in a way that infringes portrait or publicity rights (such as filming and publishing another person's face without their permission);
- filming in a way that infringes privacy (such as filming inside another person's home, a changing room, a bathroom or a toilet, filming covertly, or anything equivalent);
- infringing copyright or other rights of others;
- use the App in a place or situation where filming is prohibited;
- film obscene material or child pornography, or otherwise act contrary to public order and morals;
- interfere with the operation of the App, including by:
- tampering with, reverse engineering, decompiling or disassembling the App;
- using the App's features from a modified copy of the App or from any program other than the App;
- obstructing the display of ads or circumventing the mechanisms relating to them;
- copying, transferring, lending, redistributing or selling the App, or otherwise using it for commercial purposes;
- engage in any other conduct that we reasonably judge to be equivalent to the above.
Article 5 (Advertising)
- The App displays third-party ads. Ads appear only as a rewarded ad (a video ad you watch to the end) when you choose to save your photos or videos to your device's gallery; no ads appear while you are shooting.
- Ads are delivered by a company other than us (Google), and we do not individually select the ads that appear.
- We take no part in the content of the ads or in your dealings with advertisers; any dispute with an advertiser is to be settled between you and them.
- How the advertising company handles information is set out in sections 3 and 4 of our Privacy Policy.
Article 6 (Changes to, Suspension and End of the App)
- We may change the content of the App. We will announce in advance, in the App or on our website, any change that significantly affects users.
- We may temporarily suspend all or part of the App without prior notice in any of the following cases:
- to carry out maintenance, inspection or updates;
- where provision is difficult due to natural disaster, power failure, communications failure, system failure or other force majeure;
- where an external service the App relies on (Google Play, the ad service and so on) stops or changes its specifications;
- where we reasonably judge, for reasons equivalent to the above, that a suspension is necessary.
- We may end the App by announcing it in the App or on our website at least 30 days in advance. The App is provided free of charge, so there are no fees paid by users to refund on ending it.
Article 7 (Disclaimer of Warranties)
- We do not warrant that the App will suit any particular purpose of yours, that it will have the functionality, accuracy or usefulness you expect, or that it will be provided without interruption.
- Shooting with the front and back cameras at once may not be available depending on your device model and the specifications of its OS.
- The App relies on services provided by another company (Google), and changes to or the discontinuation of those services may make all or part of the App unavailable.
Article 8 (Limitation of Liability)
- We will compensate you for damage caused by reasons attributable to us, in accordance with this Article.
- Our liability for damages arising from our negligence (excluding gross negligence), whether in contract or in tort, is limited to ordinary and direct damages actually incurred by you and does not include lost profits or other damages arising from special circumstances.
- The preceding paragraph does not apply in cases of our wilful misconduct or gross negligence.
- The preceding two paragraphs do not apply to the extent that the Consumer Contract Act or other laws do not allow our liability to be wholly or partly excluded.
- Any dispute between you and a third party arising from what you filmed with the App is to be settled between you and them, except where we are at fault.
Article 9 (Users' Liability)
If you cause us or a third party damage by breaching these Terms or misusing the App, you will compensate for that damage.
Article 10 (Exclusion of Antisocial Forces)
- You represent and warrant, now and in the future, that you are not an organised crime group, a member of one, a person for whom five years have not passed since leaving one, a quasi-member, a company related to one, a corporate racketeer or the like, a person engaging in criminal activities under the guise of social or political movements, a special intellectual organised crime group, or any other person equivalent to these ("Antisocial Forces"), and that you have no relationship with Antisocial Forces that would be socially condemned.
- If we judge that you have breached the preceding paragraph, we may stop your use of the App without prior notice. In that case we are not liable for any damage you suffer as a result.
Article 11 (Assignment)
- You may not assign, or provide as security, your position under these Terms or any rights or obligations under them to a third party without our prior consent.
- If we transfer the business relating to the App to a third party (including by business transfer, company split, incorporation or any other form of transfer), we may transfer our position under these Terms and our rights and obligations under them to the successor, and you consent to this in advance.
Article 12 (Severability)
Even if any provision of these Terms, or part of one, is held invalid or unenforceable under the Consumer Contract Act or other laws, the remaining provisions, and the remainder of any provision held partly invalid or unenforceable, remain in full effect.
Article 13 (Changes to These Terms)
- We may change these Terms without obtaining individual users' consent, under Article 548-4 of the Civil Code, where:
- the change is in the general interest of users; or
- the change does not conflict with the purpose of these Terms and is reasonable in light of the need for the change, the appropriateness of the changed content and other circumstances relating to the change.
- Before a change takes effect, we will post on this page, or notify users of, the fact of the change, the amended Terms and the effective date at least 14 days in advance. A change that is in the general interest of users may take effect when posted.
- If you use the App on or after the effective date, you are deemed to have agreed to the amended Terms.
Article 14 (Notices and Contact)
- We give notices to users by posting them in the App or on our website, or by any other method we consider appropriate.
- Users contact us by email at the following contact point.

Article 15 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance over any dispute relating to the App. However, where the user is a consumer, this Article does not prevent the user from bringing an action in a court competent under the law.
Article 16 (Language)
The Japanese version of these Terms is authoritative. The English version and any other translations are reference translations; if they differ from the Japanese version, the Japanese version prevails.
