The Service has strict rules. If you breach these Terms, we will delete stickers or suspend your use of the Service (account termination) without notice (Article 7).

Article 1 (Scope)

  1. These Terms of Use (the "Terms") set out the conditions for using the app "Sparkle Sticker Book" (デジキラステッカー帳) and related services (the "Service") provided by VirtualCross ("we" or "us").
  2. You may use the Service once you agree to these Terms and the Privacy Policy on the consent screen shown when you first open the app.
  3. Price lists, help pages, the summary of the rules and other individual rules that we post on the Service ("Individual Rules") form part of these Terms. If these Terms and the Individual Rules conflict, the Individual Rules prevail.
  4. For users who obtain the Service from the App Store, Apple Inc.'s standard Licensed Application End User License Agreement also applies in addition to these Terms. If these Terms and that agreement differ, these Terms prevail as between us and the user.

Article 2 (What the Service Does)

  1. The Service lets you cut out photos you choose to make stickers, put them in a sticker book, and give them to or trade them with other users. You can give stickers away by link (sent through LINE or shared) or trade them with users nearby. Some features are available only to users of the Paid Plan under Article 9 (Paid Plan).
  2. The Service has no user accounts. We tell users apart by a random value the app creates on your device (the "Device Identifier").
  3. Stickers you make and your sticker book are stored on your device. A sticker is stored on our servers only when you give it away.
  4. The Service is not offered in the member states of the European Union (EU), the European Economic Area (EEA), the United Kingdom or mainland China.
  5. To prevent abuse, we use Apple's App Attest and DeviceCheck on iOS and Google's Play Integrity on Android to confirm that the Service is being used from the genuine app and device. If this cannot be confirmed, all or part of the Service may be unavailable.

Article 3 (Who May Use the Service)

  1. The Service is only for people aged 16 or over. Persons under 16 may not use it.
  2. People aged 16 or 17 must obtain the consent of a person with parental authority or other legal representative (a "Parent or Guardian") before using the Service. Buying the Paid Plan also requires a Parent or Guardian's consent.
  3. On the consent screen shown when you first open the app, we check whether you may use the Service using your year and month of birth and, for users under 18, a declaration that a Parent or Guardian has consented.
  4. Using the Service by lying about your age or a Parent or Guardian's consent is a breach of these Terms and grounds for account termination under Article 7 (Measures for Breaches).
  5. If a minor uses deception to make us believe they have legal capacity, such as by lying about their age or falsely claiming a Parent or Guardian's consent, they may not rescind contracts relating to the Service.
  6. Users under 18 are subject to the following restrictions:
    1. they cannot write messages (handwritten or typed) on the backs of stickers, and messages on the backs of stickers they receive are not shown;
    2. for stickers they make, the receiving page opened in a browser does not show the image, the sticker's name or the creator's nickname (only people who receive the sticker in the app can see it);
    3. they cannot give away stickers that the Automatic Check under Article 5, paragraph 7 judges to be revealing or provocative, such as swimwear.

Article 4 (Photos You May Use)

  1. You may only make stickers from photos you took yourself or photos the rights holder has allowed you to use.
  2. Photos showing other people may be used only with the permission of the people shown.
  3. Each time you save a sticker, you confirm that you have the right to use the photo and that you are following these Terms.

Article 5 (Rights to Stickers and Licence)

  1. Copyright and other rights in stickers you make (including messages on their backs; the same applies below) belong to you, the rights holder of the original photo or other rightful holders, and we do not acquire them.
  2. You warrant that you have the rights needed for your stickers or have permission from the rights holders.
  3. You grant us a free, non-exclusive licence to use (including to reproduce and transmit to the public) stickers you give away, to the extent needed to provide the Service (storage, delivery and display) and to investigate abuse and breaches of these Terms, and you will not exercise moral rights against us.
  4. While a sticker you give away can be received (while the link is within its validity period, copies remain and you have not cancelled it), anyone who knows the link can see its image, its name and the creator's nickname, even without the app (except stickers made by users under 18; Article 3, paragraph 6). A sticker saved on a recipient's device is not removed from that device even if its creator deletes it.
  5. Stickers you receive may only be enjoyed within the Service.
  6. We have no duty to monitor stickers. However, if we judge that a sticker falls under Article 6 (Prohibited Conduct), we may take the measures in Article 7 (Measures for Breaches).
  7. Before a sticker is given away, we automatically check its images and text with artificial intelligence (AI) (the "Automatic Check"), and stickers we judge to fall under Article 6 (Prohibited Conduct) cannot be given away or are reviewed by the operator. The Automatic Check can be wrong, and we do not warrant that its results are correct.
  8. We do not guarantee backups of stickers or sticker books.

Article 6 (Prohibited Conduct)

You must not make, save, give away or trade the following photos, stickers or messages, and must not engage in the following conduct:

  1. the following content contrary to public order and morals:
    1. obscene or sexual content, or content that suggests sexual acts;
    2. violent, cruel or grotesque content;
    3. discrimination or hate based on race, ethnicity, nationality, religion, sex, sexual orientation, disability, illness or the like;
    4. bullying, harassment, threats, defamation, or content meant to mock a particular person;
    5. content that encourages suicide or self-harm;
    6. content that promotes crime, illegal drugs, dangerous acts, or forcing others to drink or smoke;
    7. content related to organised crime groups or other antisocial forces;
    8. content that sexualises persons under 18 (we report such content to the relevant authorities immediately when we find it);
  2. the following content that infringes others' rights:
    1. content that infringes copyright (characters from anime, manga or games, illustrations, photos taken by others, TV or film screens, images from magazines or websites, logos and so on);
    2. content that infringes trademarks (company or brand logos and marks and so on);
    3. content that infringes portrait or publicity rights (photos of celebrities, photos showing other people's faces without their permission and so on);
    4. content that infringes privacy (anything showing information that identifies a person, such as names, addresses, phone numbers, school names, workplaces, car number plates, uniforms or name tags);
  3. the following conduct that interferes with the Service:
    1. impersonation, false reports, spam, advertising or solicitation, selling stickers, or other commercial use;
    2. circumventing limits on the number of copies, limits on paid features or other mechanisms;
    3. unauthorised access to or attacks on our servers, placing excessive load on them, tampering with the app, or reverse engineering;
    4. using the Service from a modified app or from any program other than the Service's app;
    5. circumventing the Automatic Check;
    6. redistributing, selling or modifying stickers you received outside the Service;
  4. conduct that breaches the law;
  5. any other conduct that we reasonably judge to be equivalent to the above.

Article 7 (Measures for Breaches)

  1. If we judge that you have breached or may breach these Terms, we may take the following measures without prior notice:
    1. deleting the sticker concerned and disabling distribution links;
    2. restricting giving away, trading, receiving and other features.
  2. If we judge that you have breached these Terms (including by lying about your age or a Parent or Guardian's consent under Article 3), we will suspend your use of the Service (account termination) without prior notice. Account termination stops all use of the Service on that device and deletes your stickers, distribution links, and records of receipts, reports and the Paid Plan from our servers. However, to prevent renewed use, we keep a record of the Device Identifier (converted into an irreversible form), the reason and the date and time. We may also set a suspension mark on the device through Apple's DeviceCheck. On a device with this mark, the Service cannot be used even after reinstalling the app or resetting the device. We handle removal of the mark individually in response to inquiries.
  3. A user whose account has been terminated must not use the Service again on another device or by any other means.
  4. Even if we take a measure under the preceding two paragraphs, we will not refund fees already received, except where a refund is made through Apple's or Google's procedures. Account termination does not cancel the Paid Plan automatically, so cancel it as described in Article 9 (Paid Plan).
  5. We may provide information to the police or other relevant authorities where required by law, where necessary to protect a person's life, body or property, or where necessary to cooperate with a national or local government body carrying out duties prescribed by law.
  6. We are not obliged to disclose our reasons for taking a measure under this Article.

Article 8 (Reporting and Blocking)

  1. If you find a sticker that breaches these Terms, tell us through "Report" (通報する) in the Service. We also accept reports at the contact point in Article 19 (Notices and Contact).
  2. We review reports, in principle, within 24 hours and take the necessary measures.
  3. You can block the creator of a sticker you received. Stickers from a blocked creator are removed from your device, and you will no longer receive them.

Article 9 (Paid Plan)

  1. You may buy "Premium" (a monthly auto-renewing subscription, the "Paid Plan") in the Service.
  2. The content of the Paid Plan is as shown in the Individual Rules (the purchase screen in the app). As of the date these Terms were last revised, it includes the original sparkle and glitter types, unlimited stickers you can make (up to 10 on the free plan; only stickers you made yourself count, and deleting one lets you make another), unlimited copies to give away (up to 2 per sticker on the free plan), placing one sticker in up to 2 spots in your sticker book (1 on the free plan; counted across all pages, and stickers already placed stay when Premium ends), sticker book pages from the second page onwards, and messages on the backs of stickers (handwritten or typed).
  3. The price is JPY 300 per month (tax included), as shown on the purchase screen and on the App Store. The price shown is the amount you pay.
  4. Users under 18 must obtain a Parent or Guardian's consent before buying the Paid Plan. Users under 18 cannot use messages on the backs of stickers even with the Paid Plan (Article 3, paragraph 6).
  5. Payment is made through the payment methods of the App Store provided by Apple Inc. on iOS, or of Google Play provided by Google LLC on Android, and payment, cancellation and refund procedures follow each company's rules. We do not receive payment details such as card numbers.
  6. The Paid Plan renews automatically for the same period and price unless cancelled at least 24 hours before the end of the current period on the App Store, or before the next renewal date on Google Play. The renewal fee is charged within the 24 hours before the current period ends on the App Store, or on the renewal date on Google Play. To cancel, on iOS open the Settings app and go to your name > Subscriptions; on Android open the Google Play Store and go to Payments & subscriptions > Subscriptions. Deleting the app does not cancel the subscription. After cancelling you can keep using the Paid Plan until the end of the current period. If you cancel partway through a period, we do not give pro-rated refunds.
  7. The Paid Plan is tied to the Apple Account or Google Account used to buy it. To use it on another device, or after reinstalling the app, use "Restore purchases" (購入を復元) in the Service. One purchase of the Paid Plan can be used on up to 3 devices. It does not carry over between iOS and Android.

Article 10 (Refunds)

  1. Except as provided by law or elsewhere in these Terms, we do not refund fees we have received.
  2. If a fault in the Service prevents you from using the features of the Paid Plan, please contact us through the contact point in Article 19 (Notices and Contact).
  3. Refunds of in-app purchases follow Apple's or Google's procedures, as set out in Article 9 (Paid Plan).

Article 11 (Changes to, Suspension and End of the Service)

  1. We may change the content of the Service. We will announce in advance on the Service any change that significantly affects users, such as a change that reduces the content of the Paid Plan.
  2. We may temporarily suspend all or part of the Service without prior notice in any of the following cases:
    1. to carry out maintenance, inspection or updates;
    2. where provision is difficult due to natural disaster, power failure, communications failure, system failure or other force majeure;
    3. where an external service the Service relies on (cloud, the App Store, Google Play and so on) stops or changes its specifications;
    4. where we reasonably judge, for reasons equivalent to the above, that a suspension is necessary.
  3. We may end all or part of the Service by announcing it on the Service at least 30 days in advance. In that case, if fees have been paid for any period after the end date, we will refund that portion (for in-app purchases, through the procedure in Article 9 (Paid Plan)).

Article 12 (Disclaimer of Warranties)

  1. We do not warrant that the Service will suit any particular purpose of a user, that it will have the functionality, accuracy or usefulness the user expects, or that it will be provided without interruption.
  2. Trading with users nearby may not be available depending on the device model, its settings and the surrounding wireless conditions.
  3. The Service relies on services provided by other companies (Apple, Google and Cloudflare), and changes to or the discontinuation of those services may make all or part of the Service unavailable.

Article 13 (Limitation of Liability)

  1. We will compensate users for damage caused by reasons attributable to us, in accordance with this Article.
  2. Our liability for damages arising from our negligence (excluding gross negligence), whether in contract or in tort, is limited to ordinary and direct damages actually incurred by the user and does not include lost profits or other damages arising from special circumstances.
  3. For users of the Paid Plan, the damages under the preceding paragraph are capped at one month's fee for the Paid Plan as it stood when the cause of the damage arose.
  4. The preceding two paragraphs do not apply in cases of our wilful misconduct or gross negligence.
  5. The preceding paragraphs do not apply to the extent that the Consumer Contract Act or other laws do not allow our liability to be wholly or partly excluded.
  6. Disputes arising from trading stickers or messages between users, and other disputes between users or between a user and a third party, are to be settled between them, except where we are at fault.

Article 14 (Users' Liability)

If you cause us or a third party damage by breaching these Terms or misusing the Service, you will compensate for that damage.

Article 15 (Exclusion of Antisocial Forces)

  1. You represent and warrant, now and in the future, that you are not an organised crime group, a member of one, a person for whom five years have not passed since leaving one, a quasi-member, a company related to one, a corporate racketeer or the like, a person engaging in criminal activities under the guise of social or political movements, a special intellectual organised crime group, or any other person equivalent to these ("Antisocial Forces"), and that you have no relationship with Antisocial Forces that would be socially condemned.
  2. If we judge that you have breached the preceding paragraph, we may terminate your account or the contract without prior notice. In that case we are not liable for any damage you suffer as a result.

Article 16 (Assignment)

  1. You may not assign, or provide as security, your position under these Terms or any rights or obligations under them to a third party without our prior consent.
  2. If we transfer the business relating to the Service to a third party (including by business transfer, company split, incorporation or any other form of transfer), we may transfer our position under these Terms, our rights and obligations under them, and users' information to the successor, and you consent to this in advance.

Article 17 (Severability)

Even if any provision of these Terms, or part of one, is held invalid or unenforceable under the Consumer Contract Act or other laws, the remaining provisions, and the remainder of any provision held partly invalid or unenforceable, remain in full effect.

Article 18 (Changes to These Terms)

  1. We may change these Terms without obtaining individual users' consent, under Article 548-4 of the Civil Code, where:
    1. the change is in the general interest of users; or
    2. the change does not conflict with the purpose of these Terms and is reasonable in light of the need for the change, the appropriateness of the changed content and other circumstances relating to the change.
  2. Before a change takes effect, we will post on the Service, or notify users of, the fact of the change, the amended Terms and the effective date at least 14 days in advance. A change that is in the general interest of users may take effect when posted.
  3. If you use the Service on or after the effective date, you are deemed to have agreed to the amended Terms.
  4. Notwithstanding the preceding three paragraphs, when we make an important change, we will ask for your agreement again in the Service. Users who do not agree cannot use the Service.

Article 19 (Notices and Contact)

  1. We give notices to users by posting them on the Service (including in the app and on our website) or by any other method we consider appropriate.
  2. Users contact us by email at the following contact point.

Article 20 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance over any dispute relating to the Service. However, where the user is a consumer, this Article does not prevent the user from bringing an action in a court competent under the law.

Article 21 (Language)

The Japanese version of these Terms is authoritative. The English version and any other translations are reference translations; if they differ from the Japanese version, the Japanese version prevails.
